IPHORUM.COM (the "Provider") is providing a service to individuals (the "User") who are at least 18 years old or minors 13 years old and above who have parental permission.
Services are freely available for use by anyone who registers as iphorum.com member, but there are some rules that you must follow when you are using our free services. Please make yourself familiar with the rules provided in our Terms of Service. Failure to comply with our Term of Service will result in removal of your account without any warning. getsmf.com disclaims all warranties or representations, express or implied, oral or written, including, without limitation, warranties of merchantability, fitness for a particular purpose, title or non-infringement. |

| This is a free service provided that our advertisements are found on all user pages. |
| 3. CONTENT RESTRICTIONS |
| Your web site must conform to the following standards to be eligible to utilize this service: |

User's content must comply in a manner consistent with any and all applicable laws in USA and social aspects. |

Provider does not verify contents of any web site using our web service. All members are responsible for everything inside their own website. All members can be held legally accountable for the contents on their website; including for example; material protected by copyright, trademark, patent, trade secret law. You are not allowed to associate your website with adult oriented material such as pornography, XXX material, Gorean, anything illegal, bigotry, racism, hatred, profanity, mail fraud, pyramid schemes, or any material which may be insulting to another person(s) or company, or depicts the exploitation of minors (children under 18 years of age). No spamming allowed, no harassing, threatening or illegal activities. |

Providers servers may be used for lawful purposes only. Transmission, storage, or distribution of any information, data, or material in violation of any applicable law or regulation is prohibited. This includes, but is not limited to: copyrighted material; trademarks; trade secrets or other intellectual property rights used without proper authorization; material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. |

| 4. DISPUTES |
| In the event it is necessary to refer any dispute to an attorney or resolve it in a court of law, the prevailing party will be entitled to an award of reasonable attorney's fees and all costs associated with any legal action, whether or not a suit shall actually be filed. |
| 5. THIS SERVICE IS PROVIDED "AS IS" |
| THIS SERVICE IS PROVIDED ON AN "AS IS, AS AVAILABLE" BASIS. THE PROVIDER GIVES NO WARRANTY, EXPRESSED OR IMPLIED, FOR THE SERVICES PROVIDED, INCLUDING, WITHOUT LIMITATION, WARRANTY OF MERCHANTABILITY AND WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. THIS NO WARRANTY EXPRESSLY INCLUDES ANY REIMBURSEMENT FOR LOSSES OF INCOME DUE TO DISRUPTION OF SERVICE BY THE PROVIDER OR ITS PROVIDERS BEYOND THE FEES PAID BY CLIENT TO PROVIDER FOR SERVICES. WE MAKE EVERY EFFORT TO BACKUP OUR DATA, BUT WE ARE NOT RESPONSIBLE FOR ANY LOSS OF DATA. |
| 6. MODIFICATION OF THIS AGREEMENT |
| This agreement may be modified at any time at the sole discretion of the Provider. Upon modification of this agreement, the User has two weeks (14 days) to terminate their account with the Provider or it will constitute acceptance of the modifications. |
| 7. LIMITATIONS OF SERVICE |
| This service is not available to Users that run other CGI hosting services as well as users who plan on developing remotely hosted CGI services. |
| 8. Backup & Service Availability |
| While Provider try to provide 99.8% uptime monthly, we do not guarantee that our services would be available every seconds. Any network downtime, files corruption and everything that could result in damages to your website are not our responsible. |
| Provider will perform weekly, and monthly backup for the entire site. Unfortunately, we do not provide sqldump for individual forum. So we are not responsible for data lost. Provider gives you the possibility to backup your content yourself. Its your responsibility to backup the content of your content. |
| 9. TERMINATION OF SERVICE |
| This service may be terminated at any time by the Provider or User. The Provider may at it's sole discretion remove any message board for any reason. |
